These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer" or "you") and Carsten Biernat ("Seller," "we," or "us") regarding your use of the online store hosted on the Weebly platform and the purchase of products produced and shipped by Printful. By accessing or using our online store and purchasing products, you agree to be bound by these Terms.
Scope
1.1 These Terms apply to all contracts concluded between the Seller and the Customer for the delivery of goods presented in the Seller's online store. Any terms or conditions proposed by the Customer that conflict with these Terms are hereby rejected unless otherwise agreed.
1.2 "Customers" within the meaning of these Terms are individuals or entities that purchase goods from the Seller's online store. "Printful" refers to the production and fulfillment partner responsible for producing and shipping the products.
Conclusion of the Contract
2.1 The products shown in the Seller's online store are not a binding offer, but an invitation for the Customer to submit a binding offer.
2.2 The Customer can submit the offer by completing the online order form on the Seller's online store. By clicking the "purchase" button, the Customer submits a legally binding offer to purchase the goods in the virtual shopping cart.
2.3 The Seller can accept the Customer's offer within five days by:
Transmitting a written or electronic order confirmation, with the Customer's receipt of the order confirmation being decisive, or
Delivering the ordered goods to the Customer, with the Customer's receipt of the goods being decisive, or
Requesting the Customer to make payment after placing the order.
If multiple alternatives mentioned above apply, the contract is considered concluded when the first of the aforementioned alternatives occurs. If the Seller does not accept the Customer's offer within the specified deadline, it shall be deemed as a rejection of the offer, and the Customer is no longer bound by their declaration of intent.
2.4 Upon submitting an offer via the Seller's online order form, the contract text is saved by the Seller and sent to the Customer along with these Terms in text form (e.g., email, fax, or letter). The contract text is no longer available on the Seller's website after the Customer has submitted their order.
2.5 Before placing a binding order, the Customer should carefully review the information displayed on the screen to detect any possible errors in the data entered. The Customer can correct any data entered using the known keyboard and mouse functions until they complete the ordering process by clicking the "purchase" button.
2.6 The contractual language is English.
2.7 Order processing and contact will primarily be conducted via email and automated order processing. It is the Customer's responsibility to provide an accurate email address during the ordering process to receive communications from the Seller or any third party involved in order processing.
Delivery
3.1 The estimated delivery time for orders is as follows:
USA: 3–4 business days
Europe: 6–8 business days
Australia: 2–14 business days
Japan: 4–8 business days
International: 10–20 business days
3.2 The products will be shipped from Printful's fulfillment centers located worldwide.
3.3 Customs and tax fees may apply to international orders. These fees are assessed by the local customs office and are beyond our control. Customers are responsible for checking with their local customs office regarding any applicable duties and taxes.
3.4 If there are any issues with the delivery, the Customer should first check the shipping confirmation email for any mistakes in the delivery address, contact the local post office, and check with neighbors. If the issue persists, the Customer should contact us with the order number.
Returns and Refunds
4.1 We offer returns and refunds for wrong items or damaged items. If the product you received is damaged or incorrect, please email us within a week of receiving the order. Include photos of the damaged product, your order number, and any other relevant details.
4.2 Exchanges for different sizes or colors are not currently offered. Customers should refer to the sizing charts provided in the product description section to ensure proper sizing. If an item is mislabeled, please contact us within a week after receiving the order, including your order number and photos of the mislabeled item.

Prices and Payment
5.1 Unless otherwise stated in the product description, the prices indicated are total prices inclusive of statutory value-added tax. Additional delivery and shipping costs are specified separately in the respective product description.
5.2 For deliveries to countries outside the European Union, additional costs may arise, such as customs fees and import duties. Customers are responsible for these additional costs.
5.3 Payment can be made using one of the options listed in the Seller's online store.
5.4 Payments made through the Weebly platform are processed via Stripe and PayPal. The handling of payments is subject to the respective terms and conditions of these payment service providers.
Liability for Defects (Warranty)
6.1 If the purchased item is defective, liability for defects will be governed by the applicable statutory regulations.
6.2 The Customer is required to promptly report any obvious transport damages to the delivery company and inform the Seller. Failure to comply with this requirement does not affect the Customer's statutory or contractual claims for defects.
Applicable Law and Dispute Resolution
7.1 These Terms and all legal relationships between the parties are governed by the laws of the Federal Republic of Germany, excluding the provisions on the international sale of goods. This choice of law applies to consumers only to the extent that it does not deprive them of the protection afforded by mandatory provisions of their country of habitual residence.
7.2 This choice of law does not apply to consumers who, at the time of contract conclusion, are not residents of a Member State of the European Union, and whose sole residence and delivery address are outside the European Union.
7.3 Any disputes arising from these Terms shall be resolved through alternative dispute resolution methods, such as mediation or arbitration, in accordance with the applicable laws and regulations.
